Welcome to toolKUDU. By creating an account or using the app, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using toolKUDU, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Each user may only have one account. Usernames must be 3–30 characters and may contain letters, numbers, and underscores.

3. Acceptable Use

You agree not to:

• Use the app for any illegal purpose
• Harass, abuse, or threaten other users
• Create fake accounts or impersonate others
• Upload offensive, explicit, or inappropriate content
• List tools that are illegal to own or transfer (e.g. weapons, controlled substances)
• Use tool listings to facilitate illegal activity
• Attempt to gain unauthorized access to the app or other accounts
• Use automated tools to scrape or interact with the app

4. User-Generated Content

You are solely responsible for the content you post, including tool listings, photos, and descriptions. We reserve the right to remove content that violates these Terms or that is reported by other users as inappropriate. Repeated violations may result in account suspension or termination. To report a listing, use the "Report this listing" option within the app or contact us at info@toolkudu.com.

5. Tool Sharing & Lending

toolKUDU facilitates connections between users who wish to share tools. We are not responsible for the condition, return, loss, or damage of any physical tools shared between users. All lending arrangements, including any paid rental agreements, are solely between the parties involved. toolKUDU does not process or hold funds for peer-to-peer rental transactions.

6. Intellectual Property

You retain ownership of content you create (tool listings, photos, profile information). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display it within the app for the purpose of providing our services. This license ends when you delete the content or your account.

7. Subscriptions & In-App Purchases

toolKUDU offers free and Pro subscription tiers. Free accounts are limited to 30 tools. Pro is available as a monthly subscription.

• iOS: Subscriptions are managed through Apple and processed by the Apple App Store. Payment is charged to your Apple ID account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. To cancel, go to iPhone Settings → Apple ID → Subscriptions.
• Web & Android: Subscriptions are processed by Stripe. You may manage or cancel your subscription through the billing portal in the app's Settings screen.

Pro features and pricing may change with reasonable notice.

8. Account Termination

You may delete your account at any time through Settings → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms. Upon deletion, all your data will be permanently removed.

9. Disclaimer of Warranties

toolKUDU is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or that the app will be error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, toolKUDU shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app or any tool-sharing arrangements made through the platform.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the app.
